Introduction

This Terms of Service document, together with our Privacy Policy (collectively, the “Agreement”), governs your access to and use of the Site. It is issued by Nexvias Solution LLP, operating as “Confirmita” (“Confirmita”, “we”, “our”, or “us”).

By using the Site, you agree to the Agreement. If you don't agree with it, please don't use the Site. Where you use the Site on behalf of an organisation, you represent that you have the authority to bind that organisation, and “you” and “your” in that case refers to that organisation as well as you personally.

The Agreement governs the Site only. Before an organisation is onboarded into the Services, it typically completes an Intake Form and agrees a Statement of Work (SOW) describing the scope of that onboarding. Once onboarded, that organisation's relationship as a Customer (including its Environment within the Services) is governed by a separate subscription or service agreement entered into between it and Confirmita, not by this Agreement.

This Agreement forms a valid, binding electronic contract under Section 10A of the Information Technology Act, 2000, and is governed by Indian law as described in “Governing law & disputes” below.

  • “Environment” means the dedicated workspace within the Services provisioned for a Customer once it has been onboarded, under that Customer's own organisation.

Using the Site

Subject to this Agreement, we grant you a personal, non-exclusive, non-transferable, revocable right to access and use the Site for your own business purposes. The Site is intended for business use and is not directed at, or intended for, individuals under 18.

When using the Site, you agree not to:

  • scrape, automate, or send a volume of requests to the Site or the Scan that goes beyond ordinary, individual use;
  • attempt to reverse engineer, decompile, or otherwise extract the source code or underlying methodology of the Site or the Scan;
  • provide access to, or make the Site or its Content available to, any third party except as this Agreement allows;
  • submit false, misleading, or malicious information through the Founding 100 Program application, the Scan, or the contact form; or
  • use the Site in a way that breaches any applicable law.

You're responsible for all activity that takes place under your own use of the Site. If you breach any of the above, we may restrict or suspend your access. See “Suspension & termination” below.

05

The free Scan

A Scan checks a website's publicly accessible pages for DPDP-relevant compliance signals, such as whether a privacy policy, cookie banner, and grievance officer details are present, and produces an indicative compliance score and a Scan Report.

A Scan is automated and runs without a human reviewing your specific website. It is not a legal audit, a certification of compliance with the DPDP Act, 2023, or a substitute for professional advice. See “No legal advice” below. Your Scan Report reflects only the public-facing signals our Scan could detect at the time it ran, and may not capture every aspect of your organisation's actual compliance position.

We don't store a copy of the scanned website's pages, source code, or the full Scan Report on our servers. Your detailed PDF report is generated in your own browser. See our Privacy Policy for what we do collect when you request a Scan.

You're responsible for only submitting a website you're authorised to have scanned. Please don't use the Scan to generate findings about a website you don't control or have permission to assess.

06

The paid Advanced Review

If your free Scan flags deeper issues, you can request a paid Advanced Review (₹599). This isn't an automated checkout. Once you request it, our team contacts you directly to confirm the scope and arrange payment. We don't collect card details on the Site itself.

Fees for an Advanced Review are payable as agreed with our team at the time you request it, and become due once the Advanced Review has been delivered to you.

Because an Advanced Review involves manual analysis and dedicated time from our team, we do not offer refunds once our team has begun that analysis, except where the Advanced Review was not delivered or was materially deficient against what was agreed. If you have a billing question or believe an Advanced Review you've received falls short, contact us using the details in “Contact us” below and we'll review it and correct any material error.

07

The Founding 100 Program

The Founding 100 Program lets the first 100 eligible organisations that complete a qualifying paid subscription lock in the annual base subscription rate of their selected plan, for as long as that subscription remains continuously active and in good standing, subject to the Founding 100 Program Terms and the subscription agreement you enter into with us.

Submitting an Application through the Site is free and does not reserve a founding place, create a subscription, or create a payment obligation. We don't collect card or payment details through the Application. Founding status, and the associated rate protection, is confirmed only once a qualifying subscription has been activated. We review Applications and may accept or decline any Application at our discretion, including where the 100 places have already been filled.

The founding rate protects the annual base subscription rate and the entitlements set out in your accepted order form. It does not extend to applicable taxes, additional usage, upgrades, premium modules, separately purchased services, or custom development outside the agreed subscription scope.

Additional conditions covering renewals, payment grace periods, downgrades, service modifications, and termination are set out in the Founding 100 Program Terms made available to you before you activate a subscription, and in your subscription agreement. Once you're a Customer, those documents, not this Agreement, govern your Environment and your relationship with us as described in “Introduction” above.

08

Intellectual property

All Content, and all intellectual property rights in it (including the “Confirmita” name and logo, the Trust Score methodology, and the design of our Scan Reports), belong to Nexvias Solution LLP or its licensors. Nothing in this Agreement transfers any of those rights to you. Except as this Agreement expressly allows, you may not copy, reproduce, modify, distribute, or create derivative works from any Content.

A Scan Report generated for your own website is yours to use for your own internal business purposes. Please don't resell, redistribute, or present it as independently verified without our written consent.

If you send us feedback, suggestions, or ideas about the Site, you grant us an unrestricted, royalty-free, perpetual right to use them without any obligation to you, and you won't be identified as their source unless we agree otherwise.

09

Confidentiality

If you share non-public business information with us through the contact form or in connection with an Advanced Review request, we'll keep it confidential and use it only to respond to you or deliver the Advanced Review. We won't disclose it to anyone outside Confirmita except where required by law, where necessary to deliver the Advanced Review, or with your consent.

This obligation doesn't apply to information that's already public, that we already lawfully held before you shared it, or that you've made public yourself. It also doesn't create any broader confidentiality relationship between us, and doesn't extend to your use of the free Scan, which only ever involves publicly accessible information about the website you submit.

11

Warranty disclaimer

The Site, the Scan, and every Scan Report are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Confirmita disclaims all warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We don't warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that a Scan Report will be accurate, complete, or current by the time you read it.

12

Indemnity

You agree to indemnify and hold Confirmita harmless from any third-party claim, loss, or expense (including reasonable legal fees) arising from: (a) your breach of this Agreement; (b) your submission of a website you weren't authorised to have scanned; or (c) your misuse of the Site. This indemnity doesn't apply to the extent the claim arises from Confirmita's own breach of this Agreement or negligence.

13

Limitation of liability

To the maximum extent permitted by law, neither party will be liable to the other for any indirect, incidental, special, or consequential damages, or for any loss of revenue, profits, or data, arising from this Agreement, even if advised of the possibility of such damages.

To the maximum extent permitted by law, Confirmita's total aggregate liability for any claim arising from this Agreement will not exceed the amount you paid us for the service giving rise to the claim or, where you haven't paid us anything (for example, use of the free Scan or a Founding 100 Program Application), ₹5,000. Nothing in this Agreement limits or excludes liability that cannot be limited or excluded under Indian law, including liability for fraud, wilful misconduct, or gross negligence.

15

Privacy

Our Privacy Policy explains what personal data we collect through the Site and how we use it, under the DPDP Act, 2023 and the DPDP Rules, 2025. It is incorporated into, and forms part of, this Agreement.

16

Suspension & termination

We may suspend or restrict your access to the Site if we reasonably believe you've breached this Agreement, misused the Scan, or where we need to for security reasons. You may stop using the Site at any time.

The following sections, which by their nature should survive the end of your use of the Site, remain in effect after it ends: Definitions, Intellectual property, Confidentiality, No legal advice, Warranty disclaimer, Indemnity, Limitation of liability, Governing law & disputes, and General provisions.

17

Notices

Any formal notice you need to give us under this Agreement should be sent to [email protected]. We may give you notice by posting it on the Site and updating the effective date above, or, where we hold your email address, by emailing you directly.

18

Governing law & disputes

This Agreement is governed by the laws of India. The courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising from this Agreement or your use of the Site, and you consent to that jurisdiction.

19

General provisions

  • Entire agreement. This Agreement is the entire agreement between you and Confirmita regarding the Site, and supersedes any prior discussions or understandings about it.
  • Severability. If a court finds any provision of this Agreement invalid or unenforceable, the rest of the Agreement remains in effect, and the invalid provision will be read to achieve its intended effect as closely as the law allows.
  • No waiver. If we don't enforce a provision of this Agreement, that isn't a waiver of our right to enforce it later.
  • Assignment. You may not assign or transfer your rights under this Agreement without our written consent. We may assign this Agreement without your consent in connection with a merger, acquisition, or sale of substantially all of our assets.
  • No third-party rights. This Agreement doesn't confer any right or benefit on anyone other than you and Confirmita.
  • Force majeure. We won't be liable for any delay or failure to perform an obligation under this Agreement where the delay or failure results from a cause beyond our reasonable control, including acts of God, internet service provider or hosting failures, denial-of-service attacks, or government action. This doesn't excuse any payment obligation that fell due before the event began. If this affects you materially, we'll let you know and take reasonable steps to resume as soon as we can.
20

Changes to these terms

We may update this Agreement as the Site or our free tools change. If we make a material change, we'll update the effective date above. Continuing to use the Site after a change takes effect means you accept the updated Agreement. We encourage you to check back here occasionally.

Compliance tooling, not legal advice. This Agreement governs confirmita.com only, not the Confirmita product once your organisation has signed up as a Customer.
